__The following document sets forth the Terms & Conditions for the Crypto Giveaway (Crypto Giveaway Terms & Conditions) sponsored by Caleb and Brown Pty Ltd (Caleb & Brown). Your participation in the Caleb and Brown Pty Ltd (Caleb & Brown) Crypto Giveaway (the “Crypto Giveaway” or “Promotion”) shall be deemed to be your complete acceptance of the Crypto Giveaway Terms & Conditions, contained herein.

General__

The Promoter is Digital Dave, the operator of the internet site https://www.crazy4cryptos.com/.
The Sponsor is Caleb and Brown Pty Ltd (ABN 66 619 023 559).Entry into the competition is deemed acceptance of these Crypto Giveaway Terms & Conditions.
If there is any inconsistency between these Crypto Giveaway Terms & Conditions and anything else that refers to this competition, these Crypto Giveaway Terms & Conditions will prevail.

Who can enter

Entrants must register and have a fully verified account with Caleb and Brown Pty Ltd (Caleb & Brown) and complete the Crypto Giveaway registration process to be eligible for the Crypto Giveaway.
Entry is open to anyone over the age of 18 except employees and immediate families of the Promoter, the Sponsor and their associated companies and agencies.
The Promoter and the Sponsor reserve the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter and the Sponsor. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter

The competition commences on 23rd of August 2022 at 12:00AM AEST and concludes on the 13th of September at 11:59PM AEST.
Entries must be received by the Sponsor prior to the competition close date and time.
The time of entry will in each case be the time the online entry is received by the Sponsor’s database, not at the time of transmission by the entrant.The Promoter and the Sponsor accept no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.

How to enter

Entrants may enter the competition by:

a. If you don’t already have a verified Caleb & Brown account and wish to participate in the Crypto Giveaway, you may do so by:

i. first registering your Caleb & Brown account via this link (https://www.calebandbrown.com/open-account?referrer=crazy4cryptos) and completing the Caleb & Brown account registration; and

ii. completing this form when your account has been verified(https://caleb-and-brown.typeform.com/c4c-giveaway).

b. If you already have a verified Caleb & Brown account and wish to participate in the Crypto Giveaway, you may do so by completing this form (https://caleb-and-brown.typeform.com/c4c-giveaway)

Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Crypto Giveaway Terms & Conditions. For the purposes of these content requirements, “entry content” includes any content (including text) that entrants submit in connection with their entry into the Promotion.
Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
The Promoter and the Sponsor reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Crypto Giveaway Terms & Conditions or who has, in the opinion of Promoter or the Sponsor, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of one of either the Promotion, the Promoter and/or the Sponsor. This includes, but is not limited to, entrants using multiple Caleb & Brown accounts as stated in Clause
Only entrants who have completed the verification of their Caleb & Brown accounts by 15th of September at 11:59PM AEST and completed the form (https://caleb-and-brown.typeform.com/c4c-giveaway), will be eligible to win. Prizes are not transferable and cannot be redeemed for cash.
There is no entry fee and no purchase necessary to enter.

Number of entries permitted

One (1) per verified Caleb & Brown account. For the avoidance of doubt, a person who opens multiple verified Caleb & Brown accounts may only enter one entry per account. For example, an individual holding both a verified personal and a verified company account with Caleb & Brown may submit one (1) entry for their personal account and one (1) entry for their company account.

Draw and Notification of the Winner(s)

The winner will be the first valid entry submitted in accordance with these Crypto Giveaway Terms & Conditions that is drawn by Caleb & Brown by random selection at 12:00PM on 15th of September 2022 at Caleb & Brown’s head office in Victoria, Australia.
The Sponsor’s decision is final. Both the Promoter and Sponsor will not enter into correspondence regarding the competition result or any other decisions the Sponsor makes in connection with the Promotion.
The winner will be notified by email within 24 hours of the draw by Caleb & Brown’s employees.Additionally, winners’ names will be published on the Sponsor’s website at https://www.calebandbrown.com/crazy4cryptos-calebandbrown-crypto-giveaway-2022.

The prize(s) will be awarded to the person named in the entry. However, in a dispute, the prize(s) will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. Internet Service Provider account holder).
Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter and/or the Sponsor. A request to access or modify any information provided in an entry should be directed to the Promoter and/or the Sponsor.
In the event that the winner is not able to be contacted, the Sponsor will continue to attempt to contact the winner over a two (2) week period starting a day after the draw of results, at which point the prize will be forfeited.
Any forfeited prize(s) will be null and void.
A winner’s name will be available for twenty-eight (28) days after the competition closing date by emailing the following address: [email protected]‍

Prize on offer

The prize contains the following: a. US$2,000 per winner, to be credited to the winner’s Caleb & Brown account (x5)
The Promoter and the Sponsor accept no liability for any injuries or other experienced by the winner while undertaking activities or travel related to this competition and prize.
The Promoter and the Sponsor accept no liability for costs incurred whilst undertaking activities related to this competition.The Promoter and the Sponsor is not responsible for inaccurate prize details supplied to any entrant by any third party connected with a game.
The prize is as stated and no cash or other alternatives will be offered. A prize(s) are not transferable. Prize(s) are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
All prizes must be used for a purchase of cryptocurrency through Caleb & Brown by 31 December 2022, subject to subclause 31 a. A purchase of cryptocurrency cannot include stablecoins.
The winning entrant(s) shall be solely responsible for any taxes levied in relation to the delivery or receipt of the prize(s).

Use of Personal Information

Any personal information you provide in the course of the Crypto Giveaway will be subject to the Crypto Giveaway Terms & Conditions, the Sponsor’s Terms of Business (provided on Caleb & Brown’s website) and to the Sponsor’s Privacy Policy (collectively, the “Terms & Conditions”). You agree that the Promoter and/or the Sponsor will use the contact details you provided as part of your entry to publish the winners’ names and to contact you in the event you are selected as one of the winners.
The prize recipient(s) agrees to the use of his/her name and image in any publicity material related to the Crypto Giveaway, as well as their entry.
All entrants consent to the use or disclosure of any information, including but not limited to, personal information, collected as part of the registration process of the Crypto Giveaway, for marketing purposes of Caleb & Brown’s services and for any other lawful purpose as required or authorised by or under Australian law or a court/tribunal order. Any personal data will not be disclosed to a third party without the entrant’s prior consent.
By entering the Crypto Giveaway, you agree to your personal information being used for the purposes described in these Terms & Conditions, including the purposes of assessing your eligibility, administering the Crypto Giveaway, prize fulfilment, publication of winners, for contacting you if you are selected as a winner, and for the marketing purposes of Caleb & Brown’s services (as provided on Caleb & Brown’s website under the ‘Terms of Business’ page).
You are providing your information to Caleb & Brown and Digital Dave and not to any other party. The information provided will be used in conjunction with Caleb & Brown’s Privacy Policy.

Other

The Sponsor reserves the right to cancel or amend a game and these Crypto Giveaway Terms & Conditions without notice in the event of a catastrophe, war, civil or military disturbance or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Sponsor’s control. Any changes to a game will be notified to entrants as soon as possible by the Promoter and/or the Sponsor.
These Crypto Giveaway Terms & Conditions and the Crypto Giveaway itself will be governed and construed by the laws of Victoria.
All entrants agree that any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
Any officer (as defined in the Corporations Act) can rely on the provisions of the Terms of Business provided on Caleb & Brown’s website relating to any exclusion or limitation of liability applicable to them. Save for our officers, no person who is not a party to these Terms & Conditions (both Caleb & Brown’s Terms of Business and these Crypto Giveaway Terms & Conditions) may enforce any of their provisions or rely on any exclusions or limitation of liability contained herein.
All promotions are in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network.
To the extent that is permissible by law, the Promoter and/or the Sponsor is not responsible or liable for:

a. inaccurate or incorrect transcription of entry information; b. non receipt of entries for any reason; c. problems or technical failures of any kind; d. unavailability or inaccessibility of service or website; e. unauthorised human intervention in any part of the Crypto Giveaway; f. electronic or human error; g. any damage or loss (direct or indirect) suffered by any reason of any act or omission of the Sponsor, its employees, or contractors in relation to the Crypto Giveaway or supply of prize(s); h. any damage or loss (direct or indirect) suffered by any reason of any act or omission of the Promoter, its employees, or contractors in relation to the Crypto Giveaway or supply of prize(s).
